in foreclosure, there is a good chance that many people will approach you to buy your home. They will send you letters, knock
on your door and call your home. They will drive by your house and may even try to look in your windows! They will all
say they can help. But can you believe and trust what they say?
Some will even say they can stop your foreclosure and allow
you to keep your home. Sounds perfect, right? Maybe and maybe not.
It is our opinion that there are key points you must
keep in mind if you are to protect yourself and succeed.
1. Be Careful When Considering Approaches That Say You Can Keep Your
House.
- Some people will say that if you put them on the deed, they will stop your foreclosure, cure the default and make the payments.
- Others
say you put them on the deed AND pay a fee AND make a higher payment on a new loan.
- Others will say they will buy your house
and lease it back to you allowing you an option to buy it back.
- While some of these schemes may work, they may not be for you.
You may be paying, one way or another, for these options. And in some cases you will be forking over a great deal of money in
up front payments, high interest rates, and even by paying a much higher price to buy your home back (under that option arrangement).
- And
keep in mind that the PEOPLE WHO ARE ASKING FOR YOUR DEED PROBABLY DO NOT PERSONALLY HAVE THE CASH TO BUY YOUR HOUSE ANYWAY (even
though they may lead you to believe that they do).
- People who "buy houses" without the cash to buy may lack a key element
to successfully assist you (not to mention the experience and skills to actually stop a foreclosure and solve the problem you
must have solved). Maybe there is a good reason they do not have the cash in their bank accounts to buy. This is
a key issue for you to evaluate!

3. Now May NOT Be The Time To List Your House With A Real Estate Agent.
- It is our opinion that if you decide to sell your house to
get cash and close BEFORE the auction, you must succeed and act quickly.
- When listing your home, you are simply hoping that the
agent can find the right buyer, that the buyer offers the right price, that he has the money to buy or is prequalified with a
bank AND can actually close fast enough.
- This is in our opinion, a long shot. You have far too much at risk. Again,
you must act quickly - listing can use up precious time with no assurance your house will be sold. The clock begins ticking,
quickly, once the bank starts the foreclosure process.
4. Do Your Homework.
- It is our opinion that a foreclosure is important enough
for you to take some time to become educated. If you have access to the internet, you should consider getting on the website
of your State's government and doing a search for the foreclosure laws and regulations that are on the books (or go to your
local library - state codes are usually available there as well).
- Laws vary by state, and include such things as the requirements
or rules by which you mortgage company must play. You have rights that are protected by law, as does your mortgage company
or bank. There are requirements for publishing public notices, the amount of time you are given to respond, late payment
details, etc. All of this information is available to you and can help your create the best strategy for yourself.
- Seek
the advice of a professional if you are having any difficulty understanding the laws and regulations.

two years, work with my bank and get everything settled. I am calling you because
it's only a few months since I hired them and the
bank started the foreclosure process. They didn't do
what they said. They didn't refund my money. They didn't even

"A guy came and put a card in my door saying he could help me. He offered me the lease option plan. I pinned him
down finally. He
said he would charge me $35,000.00! I can't believe it...I was blown away by him. IT WAS LIKE GETTING SLAPPED! I get tons of
letters from people (wanting to buy my house). I was totally
inundated by those letters. I throw them in the garbage..." LJ, NH
3. "...I had a couple of clowns come in and
try to assume my loan for nothing. They were the ones from the infomercials. I'm familiar with
their process.
The propositions they gave me were ridiuclous. I had one guy who was going to take over my payments then he was
going to rent it for a year. I am sorry for the people who fall for it..." CG, FLORIDA
4. A company
in Massachusetts puts out literature that they are "the solution" to foreclosure problems. They say they will help even if
the homeowner has no equity. They use the word "cash" in huge letters with lots of dollar signs. One of their victims
gave us a copy of
the Purchase and Sale Agreement - where this company tried to "buy" their home. The contract had
NO prices or cash amounts
filled in and had a long list of escape clauses for this company. They persuaded
the homeowner to sign a contract with the
BLANK spaces, missing price and payment information. Yow!!! We would
have shown them the door immediately, then contacted
the Office Of The State Attorney General.
5. We
were called by a homeowner AFTER he was contacted by another so-called "investor". This investor has "buy houses" signs
plastered all over our local town. He uses the word cash - yet one might conclude thathas very little of his own.
A homeowner told us,
"...said he would bring (me) current on (my) first mortgage and second and give me
some cash - if I signed over the deed to him, but
the mortgage would still be in my name!" GK, NH
If this was a legitimate and traditional purchase and he actually had the CASH to buy, why in the world would this "buy
houses guy" insist that the mortgages stay in the name of the Homeowner - yet HE gets to have the deed in HIS name?!?
So...if
